These general terms of sale govern every order placed on lamaisondutcg.com. They may change: the conditions applicable to an order are those in force at the time it is validated.
Article 1, Purpose
These general terms of sale (GTS) define the rights and obligations of La Maison du TCG, a French SAS with a share capital of EUR 1,000, registered with the Paris Trade and Companies Register under number 107 246 324, whose registered office is at 229 rue Saint-Honoré, 75001 Paris (the "Seller"), and of any natural person acting for non-professional purposes (the "Customer") in the context of the online sale of trading cards, sealed products and accessories on lamaisondutcg.com. Any order implies acceptance of these GTS in the version in force on the day of the order.
Article 2, Products
The products offered for sale are new, sealed products, described as accurately as possible. Photographs illustrate the products but are not contractually binding. Offers are valid while stocks last.
Article 3, Prices
Prices are shown in euros, all taxes included, excluding delivery costs. La Maison du TCG reserves the right to change its prices at any time. Products are invoiced on the basis of the rates in force at the time the order is validated.
Article 4, Orders
An order is confirmed once payment has been validated. A confirmation email is sent to the address provided. As long as the order has not shipped, the customer may ask for it to be cancelled, free of charge and without giving any reason, by writing to contact@lamaisondutcg.com: they are then refunded in full, to the payment method used, no later than 14 days after the request. This also applies to pre-orders, up until they ship, and is without prejudice to the right of withdrawal set out in Article 7. La Maison du TCG reserves the right to cancel any order in the event of a proven dispute with the customer, suspected fraud or stock shortage; in the latter case, the customer is refunded in full.
Article 5, Payment
Payments are secure and processed by Shopify Payments (bank card, Apple Pay, Google Pay) and PayPal. The charge is made when the order is validated.
Article 6, Delivery
Orders are prepared within 48 working hours, then shipped from France and delivered with tracking, to a pickup point or to your home. Shipping fees are payable by the customer whatever the order amount; they are calculated at the cart before validation, based on destination and weight, and displayed before any payment. Detailed costs and delivery times per destination are shown on the Shipping page. In accordance with Article L216-4 of the French Consumer Code, the risk of loss or damage to the goods is transferred to the customer when the customer, or a third party designated by them, takes physical possession of the goods.
Article 7, Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal, without having to give any reason or pay any penalty. This period expires 14 days after receipt of the order (of the last item if it is delivered in several shipments); the right may also be exercised as soon as the order is validated, before shipment (Article 4). It applies to the entire catalogue, including pre-orders and mystery boxes. To exercise it, simply send to contact@lamaisondutcg.com, or by post to the registered office stated in Article 1, any unambiguous statement, for example the model form reproduced below; practical details are set out on the Returns page. The customer must send the items back no later than 14 days after their notification, and bears the cost of returning them. The refund covers all sums paid, including initial delivery costs (at the standard rate), no later than 14 days after La Maison du TCG is informed of the withdrawal; it may be deferred until the items are recovered or proof of their shipment is provided, and is made using the payment method used at purchase. The customer is only liable for any diminished value of the items resulting from handling other than what is necessary to establish their nature and characteristics; opening a sealed product (booster, display, mystery box) goes beyond such handling and may lead to a deduction matching the loss of value, as the value of these products lies essentially in their being sealed.
Article 8, Legal guarantees
Independently of any commercial guarantee, the Seller remains bound by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). Article 9, Loyalty program
1. Principle. Every holder of a customer account benefits from the La Maison du TCG loyalty program. The program awards experience points (XP) and store credit based on orders placed.
2. Earning XP. Each euro (incl. VAT) actually paid for products, excluding delivery costs, earns 1 XP. XP is credited when the order ships. No other action generates XP.
3. Ranks. Accumulated XP determines the customer's rank: Novice (0 XP), Collector (150 XP), Super Collector (1,000 XP), Ultra Collector (2,500 XP), Master Collector (5,000 XP), Legend (10,000 XP).
4. Cashback. Each rank entitles the customer to cashback credited as store credit: Novice 0%, Collector 1%, Super Collector 1.5%, Ultra Collector 2%, Master Collector 2.5%, Legend 3%. The applicable rate is that of the rank held at the time of the order. Cashback is calculated on the amount (incl. VAT) actually paid for products, excluding delivery costs, after discounts and after use of any existing balance. It is credited when the order ships.
5. Nature of the balance. Store credit is a commercial credit usable exclusively on lamaisondutcg.com. It cannot be converted into euros, transferred or refunded. It applies to the product amount and cannot be used to pay delivery costs.
6. Validity. The balance remains valid as long as the customer places at least one order every 6 months; the deadline is extended when each order ships. Otherwise it is permanently lost. An information email is sent 30 days before the deadline.
7. Refunds and cancellations. If an order is refunded or cancelled, the corresponding XP and cashback are withdrawn. If the balance has already been used, the corresponding amount is deducted from the refund.
8. Referral. The referrer receives EUR 5 of store credit when their referee places their first order, subject to the following cumulative conditions: (i) that order reaches EUR 60 incl. VAT in products, (ii) the 14-day withdrawal period has expired, (iii) the referee has never held an account on the site, (iv) only one referral is counted per referee. Credit obtained in this way follows the same rules as cashback.
9. Changes. The loyalty program may change at any time. Ranks already earned remain earned. The conditions applicable to an order are those in force at the time it is validated.
10. Abuse. La Maison du TCG reserves the right to suspend or close an account, and to cancel the associated benefits, in the event of manoeuvres aimed at circumventing the program (multiple accounts, fake referrals, fictitious orders).
Article 10, Liability
La Maison du TCG cannot be held liable for damage resulting from misuse of the product, force majeure or temporary unavailability of the site. This clause does not deprive the customer of the legal guarantees in Article 8 or the transfer of risk provided for in Article 6.
Article 11, Mediation and disputes
These GTS are governed by French law. In the event of a dispute, the customer should first contact customer service (contact@lamaisondutcg.com) to seek an amicable solution. The mediator may be contacted within one year of the written complaint sent to customer service. Failing an amicable resolution, any dispute will be submitted to the competent courts.
